Introduction

SnS ERRAND SERVICE operate various services, including but not limited to vehicle sharing and the development, operation, and management of the SnS ERRAND SERVICE application/website, which stands as the flagship franchise of the company. SnS ERRAND SERVICE offers online car rental, member subscriptions for online car rentals, tracking and cancellation of bookings, as well as marketing and promotion of online services, among other associated services. Our online car sharing platform connects vehicle owners with travelers and locals seeking to rent cars. By accessing or using our services, you agree to abide by these Terms of Service (referred to as “Terms”), forming a legally binding agreement between you and SnS ERRAND SERVICE, regardless of your registration status. These Terms, along with SnS ERRAND SERVICE’s Privacy Policy, applicable insurance terms and certificates, roadside assistance terms, and user policies accessible via the Services, collectively constitute the “Agreement” between you and SnS ERRAND SERVICE.


Modification:

SnS ERRAND SERVICE reserves the right, at its sole discretion, to modify the Services or the Agreement, including these Terms, at any time. Any modifications to these Terms will be posted on the Services, with the “Last Revised” date updated accordingly. Your continued use of the Services following such modifications indicates your acceptance of the amended terms. If you do not agree to the modified terms, your only recourse is to discontinue using the Services and close your Account.


Eligibility, Registration, Verification:

Eligibility:

SnS ERRAND SERVICE is intended exclusively for licensed drivers aged at least 21 years old. The Service is not accessible to users previously banned due to violations of our terms, unless reinstatement is granted in writing. All users must meet our Eligibility Requirements and provide complete documentation to determine eligibility at any point during their usage of the Service, as requested at our discretion.

Registration:

Certain features of the Services require users to create an account (“Account”). To reserve a vehicle, users must apply for a “Riders” Account, while those wishing to share their vehicle must apply for a “Partners” Account.

Verification:

SnS ERRAND SERVICE reserves the right and obligation to conduct screenings and checks to verify user identities, driver’s license validity, and vehicle details. Third-party services may be employed for this purpose, and users consent to the collection and use of relevant information for verification purposes.

Payment:

General:

Payments for SnS ERRAND SERVICE’s Services are based on a daily rate and are due at the end of each month. The rates specified herein are comprehensive of all Services provided by SnS ERRAND SERVICE to third parties under this Agreement, without any additional compensation for general administrative expenses.

Payment Details:

All electronic payments to SnS ERRAND SERVICE shall be facilitated through the Paystack Payment System or other agreed-upon mediums and must be made in advance. Registration of Partners and Vehicles with SnS ERRAND SERVICE is deemed complete upon recording the Partners’ and Vehicles’ details in the Car listing inventory.

Your Commitments:

You agree to use your SnS ERRAND SERVICE Account and the Services in accordance with these Terms, applicable laws, and any other provided policies and standards. You are solely responsible for all activities conducted through your Account and must maintain the security of your Account information. You must provide accurate and up-to-date information during registration and usage of the Service.

– Customers are not allowed to make any changes on the car unless they ask the managers for the car permission

– Customer will have to fuel the car on return


Content:

User Content:

Subject to our discretion, you may post content through the Services, such as photographs, reviews, and descriptions. By making such content available, you grant us the right to use, modify, distribute, and exploit the content to promote the Services, while acknowledging that you retain ownership rights to your content.

Prohibited Activities:

You agree not to engage in prohibited activities while using the Services, including violating laws, diluting the SnS ERRAND SERVICE brand, providing false information, or interfering with the operation of the Services. We reserve the right to take actions, including limiting, suspending, or terminating your Account, in response to violations of these Terms.

Other Legal Matters:

Violations:

We reserve the right to take action, including limiting, suspending, or terminating your Account, if we believe you are abusing the platform or violating these Terms.

Communication:

We may contact you using pre-recorded messages, calls, or text messages for various purposes, including confirming your signup, providing notices regarding your Account, investigating fraud, or communicating urgent messages.

Non-Disparagement:

Both parties agree not to take any actions that could harm the reputation of the other party or lead to unwanted publicity.

Insurance and Protection Plans:

We do not provide insurance to Partners or Riders. Protection plans available through the Services are independent, and eligibility is contingent upon compliance with these Terms.

Specific Terms for Riders:

The following provisions also pertain to individuals who book a vehicle using the Services:

Riders’ Commitments:

As a Rider, you agree to the following commitments:

– You must possess a valid driver’s
license and provide proof of its current validity to the Partner or through the
Services.

– Treat the vehicle and any additional features with care, ensuring their timely return and maintaining their condition.

– Allow only individuals listed in the trip details as Approved Drivers to operate the booked vehicle.


Financial Responsibility for Vehicle Damage:

Primary Riders are financially responsible for any physical damage or theft of the booked vehicle during the trip, along with associated costs and fees, regardless of fault. This responsibility remains regardless of whether the primary Rider has personal auto insurance.

Auto Liability Insurance:

Most Partners do not provide liability insurance. All protection plans offered include coverage under a third-party automobile liability insurance policy.

Vehicle Use:

– Vehicles booked through SnS ERRAND SERVICE are for personal use only and may not be used for commercial purposes.

– Access to the vehicle is permitted only at the start time of the trip, and it must be returned punctually and to the agreed location.

– Presentation of a valid driver’s license is mandatory.

– Responsible and lawful operation of the vehicle is required at all times, complying with speed limits and driving laws.

Vehicle Theft:

Failure to adhere to specified guidelines regarding vehicle return, misrepresentation of facts, or failure to cooperate with authorities may result in reporting the vehicle as stolen, potentially leading to legal consequences.

Specific Terms for Partners:

The following provisions apply to individuals who share their vehicles through the Services:

Partner Commitments:

– Ensure the safety and cleanliness of the vehicle, complying with all applicable regulations.

– You must possess a valid driver’s license and provide proof of its current validity to the Partner or through the Services.

– Maintain the vehicle in good working condition, conducting necessary maintenance as recommended by the manufacturer.

– Provide accurate vehicle descriptions and maintain updated vehicle inventory.

– Respond to rental requests within 24 hours.

– Adhere to legal, regulatory, and ethical obligations related to professional practice when renting vehicles through the site.

Photography:

Partners may opt to have photographers take photographs of their vehicles. Partners are solely responsible for using these images in their listings. SnS ERRAND SERVICE reserves the right to use these images for various purposes without further notice or compensation.

Pricing, Earnings, and Payments:

Partners have the flexibility to set and revise vehicle pricing. SnS ERRAND SERVICE will remit the amount collected from Riders, less applicable fees, to Partners based on their chosen payment plan.

Maintenance Responsibilities:

The Owner agrees to the following maintenance responsibilities:

– Ensure the safety and cleanliness of the vehicle, both internally and externally.

– Adhere to all regulations, including those concerning the presence of safety equipment such as a safety vest and warning triangle.

– Ensure that any special equipment provided in the vehicle complies with safety standards.

– Keep the vehicle in perfect working order by conducting regular reviews and maintenance as recommended by the manufacturer.

– Conduct an audit in response to any reported problems, technical malfunctions, or degradation following a lease.

– Verify that there is no incompatibility between their own insurance contract and the use of the SnS ERRAND SERVICE.

– Provide a compliant vehicle description, including photos, and update the vehicle inventory as needed.

– Keep an up-to-date copy of the vehicle inventory and the SnS ERRAND SERVICE flyer inside the vehicle’s glove compartment.

– Ensure the fuel tank is full before each rental.

– Inform SnS ERRAND SERVICE of any particulars related to the use of the vehicle or parking arrangements.

– Understand and comply with legal, regulatory, and ethical obligations when renting vehicles through the site.

– Regularly check the vehicle for defects in its operations or safety.

– Ensure the vehicle is in safe and roadworthy condition, complies with all applicable inspection and registration requirements, and has a clean title.

– Respond to any applicable recall or safety notices and complete any recommended actions before allowing the vehicle to be booked.

– Address any concerns raised by SnS ERRAND SERVICE regarding the vehicle’s conformity to reasonable standards.

– Report any damage to the vehicle promptly and cooperate with the investigation to determine eligibility for coverage.

– Take appropriate action in case of missing vehicles, including contacting SnS ERRAND SERVICE and cooperating with authorities in the investigation.

– Be indemnified by their insurers for any loss or injury occurring during the use of the vehicle by a client, subject to compliance with terms and conditions and any policy exclusions or limitations.

Liability and Indemnification:

Partners and Riders agree to defend and indemnify Indemnitees against claims arising out of damage to a vehicle, injury, or property damage, regardless of fault. Indemnification does not apply in cases of sole negligence or willful misconduct of the Indemnitee.

Limitation of Liability of SnS ERRAND SERVICE:

SnS ERRAND SERVICE’s liability is limited to the services provided, and it cannot be held responsible for various issues, including vehicle theft or damage during a lease. Users acknowledge and accept this limitation of liability.

User Responsibilities:

Users are required to adhere to specific terms and conditions when using the service, including but not limited to safe driving practices, reporting defects, and complying with rental terms. Failure to comply may result in termination of access to the service and other consequences.

Confidentiality:

Technical information provided shall be used only for service performance and shall not be disclosed to third parties without consent.

Applicable Law and Dispute Resolution:

The agreement is governed by the laws of the Republic of Ghana, and disputes shall be resolved through the courts of Ghana.

Termination:

– Either party may terminate the agreement with notice. Termination does not release a party from prior obligations.

– Cancellation requests must be submitted in writing at least 48 hours prior to the scheduled rental start time.

– Any cancellations made within 48 hours of the rental start time will result in a forfeiture of the full rental fee.

– Cancellations made more than 48 hours in advance will incur a cancellation fee equal to 25% of the total rental cost.

– In the event of unforeseen circumstances, such as extreme weather conditions or equipment failure, the rental business reserves the right to cancel the rental without penalty.

– Refunds for cancellations made within the allowable timeframe will be processed within 7-10 business days from the date of cancellation request.

Changes to rental dates or equipment can be accommodated based on availability, but may be subject to additional fees or charges.


Miscellaneous:

Various provisions cover waiver, language, notices, and the understanding that SnS ERRAND SERVICE is not a rental car company. The agreement encompasses the entire understanding between the parties and supersedes earlier communications. Users may not delegate their legal obligations without consent.
